Mainstream Media AG, Bavariafilmplatz 7, 82031 Grünwald (“Mainstream Media“, “we” or “us“) processes your personal data in connection with your use of our website www.worldoffreesports-tv.de (“Website“). The protection of your personal data is very important to us. We process your personal data in order to provide you with the Website, respond to your contact inquiries, send you our newsletter, conduct prize draws, provide videos, or use cookies on our Website. This privacy policy (“Privacy Policy”) describes the processing of your personal data in connection with your use of the Website.

  1. 1. Who is responsible for the data processing? Mainstream Media is responsible for the processing of your personal data in connection with the Website.

For what purposes, for how long, and on what legal basis do we process which personal data? “Personal data” within the meaning of this Privacy Policy is any information relating to the personal or factual circumstances of an individual that makes it possible to identify that person. This includes, for example, your name and email address, but also, for example, your IP address. We collect, process, and use (collectively “process” or “processing”) your personal data for the purposes set out below:
    1. 3.1. When using the Website You can browse our Website without us processing any personal data about you, provided you have objected to the use of cookies. Information on data processing through cookies, if you have not disabled cookies, can be found in section 3.5 of this Privacy Policy. In addition, we process the following data about your use of the Website to ensure its proper functioning and to guarantee IT security (“Usage Data”): browser type, browser version, operating system used, referrer URL, hostname of the accessing device, time of the server request, IP address.We process this Usage Data on the basis of our legitimate interest (Art. 6(1)(f) GDPR) in providing the Website in a functional and secure manner.

      We delete your Usage Data immediately after the usage process and once it is no longer required to perform the contractual relationship or for IT security purposes. Beyond that, we only process your Usage Data to assert or defend against legal claims or to comply with statutory retention obligations.

    2. 3.2. When sending the newsletter You can sign up for our email newsletter. We then process the following personal data (“Newsletter Data”): email address and newsletter content. We also evaluate your use of our email newsletter in order to further optimize it. For this purpose, we process the following personal data (“Newsletter Usage Data”): whether you opened the newsletter and which links you clicked. We process your Newsletter Data and Newsletter Usage Data on the basis of your consent (Art. 6(1)(a) GDPR). You can withdraw your consent to receive our email newsletter at any time with effect for the future, e.g. by email to kontakt@mainstream-media.ag. The processing of Newsletter Data prior to the withdrawal of consent remains lawful.We also process the following personal data in order to be able to demonstrate your consent (“DOI Data”): IP address, time of sign-up for the email newsletter and confirmation of the email address, click on the confirmation link in the confirmation email, and content of the consent declaration.

      We process your Newsletter Data, DOI Data, and Newsletter Usage Data only until you withdraw your consent. Beyond that, we only process your Newsletter Data, DOI Data, and Newsletter Usage Data to assert or defend against legal claims or to comply with statutory retention obligations.

    3. 3.3. When you participate in prize draws We process the following personal data when you take part in prize draws on www.worldoffreesports-tv.de via the Website (“Prize Draw Data”): name, address, email address, phone number, date of birth, cable/IPTV/satellite provider, materials submitted (e.g. for photo contests). We process your Prize Draw Data so that you can take part in our prize draws and so that we can conduct the draws, notify you of any prize won, and report on winners in the media (e.g. on the Website or the websites of cooperation partners). If you have won a sum of money, we also process your bank details and may transmit them to our payment service provider so that the amount won can be transferred to you. If partners of ours fulfill the prize (e.g. for travel or event prizes), we also transmit the winner’s Prize Draw Data to our cooperation partners (e.g. travel or event organizers) for this purpose. We process your Prize Draw Data for contract performance (Art. 6(1)(b) GDPR). The relevant contract is the prize draw participation agreement.We process your Prize Draw Data for the duration of the prize draw. Beyond that, we only process your Prize Draw Data to assert or defend against legal claims or to comply with statutory retention obligations.

    4. 3.4. When you contact us When you contact us, we receive personal data from you. Depending on the type of contact (e.g. contact form, email, or phone), this may include the following personal data in particular (“Communication Data”): name, email address, subject of your inquiry, how you receive our channel www.worldoffreesports-tv.de, timestamp of the inquiry, IP address, any information relating to your inquiry, and any other information you provide to us when contacting us. We process this Communication Data exclusively to handle your contact inquiry.     6. 3.6. When using Vimeo Our Website includes Vimeo videos that can be played directly on our Website. This involves the use of plugins from the video portal Vimeo. The operator is Vimeo, Inc., 555 West 18th Street, New York, New York 10011, USA (“Vimeo”). We have integrated Vimeo’s videos using a privacy-friendly solution. Only when you click on a video is a connection established to Vimeo’s servers, and certain personal usage data (e.g. your IP address and which video you are watching) is transmitted to Vimeo. As long as you do not click on the video to watch it, you remain invisible to Vimeo. We use this privacy-friendly solution so that Vimeo does not track your usage behavior without your active involvement. By clicking on the video, you consent to data processing by Vimeo. Vimeo then processes at least the aforementioned usage data. Vimeo is responsible for the data processing it carries out and for its use of cookies. Please note that this transmission occurs regardless of whether you have a Vimeo user account and are logged in or not. If you are logged into your personal Vimeo account, Vimeo will be able to associate your browsing behavior with your personal profile.       Use of a messaging service is, of course, voluntary. If you have subscribed to a messaging service and no longer wish to use it, you can unsubscribe at any time. The lawfulness of processing based on your consent up until withdrawal remains unaffected.

Social media presence / use of fan pages on social networks If you use social networks, the purpose and scope of data collection, as well as the further processing and use of data by the social networks, along with your related rights and settings options for protecting your privacy, are generally governed by the privacy notices of the respective social network:

      If you have questions regarding the protection of your rights as a data subject, you can contact Facebook, Instagram, or us directly. Primary responsibility under the GDPR for processing Facebook/Instagram’s so-called Insights data lies with Facebook/Instagram (Meta). The corresponding GDPR obligations are fulfilled accordingly. Facebook/Instagram provide data subjects with the essential content of the agreement regarding Insights data between Facebook/Instagram and the fan page operator. This means, in particular, that as the operator of the fan page, we do not make any decisions regarding the processing of Insights data and any further information arising from Art. 13 GDPR in this regard, including the legal basis, the identity of the controller, and the storage period of cookies on users’ devices.

      If you visit our fan pages on social networks and comment on and/or rate posts there, or send us personal messages via these networks, we process the personal data provided in this context, such as your name, in order to respond to your comments and messages. Of course, you can also visit our fan pages without providing us with any personal data.

  4. 4. To which recipients do we transmit your personal data? We disclose your personal data in the specific cases mentioned above for the individual data processing operations. In addition, we only disclose your personal data to third parties in the rare cases described below:

Processors We may transmit personal data to service providers with whom we cooperate, for example, to provide the Website (e.g. IT service providers such as ETES GmbH as the Website’s hosting provider).     8. 5.8. Right to lodge a complaint with a data protection authority You may also lodge a complaint with the competent data protection supervisory authority if you believe that we are unable to adequately assist you.
  6. 6. Is there any automated decision-making? We do not use automated decision-making, including profiling, within the meaning of Art. 22 GDPR to provide our respective services.
